Highmark Home Solutions – Waiver of Liability Agreement

This Waiver of Liability ("Agreement") is entered into between Highmark Home Solutions ("Contractor") and the undersigned Client ("Client") for the performance of handyman and/or routine home maintenance services.
1. Scope of Services
Client understands that the services provided by Highmark Home Solutions are limited to minor repairs, general maintenance, and preventative inspections. Services are intended solely to minimize normal wear and tear and promote the ongoing upkeep of the property. Contractor does not perform licensed work related to HVAC systems, plumbing, electrical, or appliance repair, unless otherwise agreed upon in writing.
2. Assumption of Risk
Client acknowledges and agrees that any property component — including but not limited to HVAC units, water heaters, appliances, plumbing fixtures, and electrical systems — may naturally fail or degrade over time. Contractor's services are not a substitute for licensed inspection, replacement, or repair of such systems.
Client agrees to assume full responsibility for the functionality, lifespan, or future condition of such systems, whether or not the Contractor’s services involve or relate to them.
3. Limitation of Liability
Contractor shall not be held liable for:
Any damage, defect, failure, or malfunction of mechanical systems, structural elements, or appliances
Any existing or future issues arising from wear, age, or prior work performed by other contractors or homeowners
Indirect, incidental, or consequential damages, including loss of use or income, related to services rendered
Client agrees to release, discharge, and hold harmless Highmark Home Solutions and its owner/operator (Jacob Child) from any claims, demands, or liabilities that may arise, directly or indirectly, from the work performed.
4. Damage Notification
In the unlikely event that accidental damage to the property occurs during the provision of services, Client must notify Contractor in writing within 72 hours. Claims submitted after this window may not be considered valid. Any agreed-upon remedy shall not exceed the total amount paid for the specific service provided.
5. Acknowledgment
By signing below, Client acknowledges they have read and understood this Waiver of Liability and agree to be bound by its terms. This waiver shall remain in effect for all current and future services unless otherwise modified in writing.
